Terms and Conditions of Sale

1. Introduction
These Terms and Conditions of Sale govern the sale of all products bearing the “Giuliva Heritage” brand through the official website www.giulivaheritage.com.
All purchases made through the Website are processed and fulfilled by our global e-commerce partner, Global-e, which acts as the seller of record (the entity that legally owns the product or service at the time of sale and is responsible for the transaction, including order fulfillment, customer service, and potentially, tax collection and remittance). By placing an order, you (the "Client") agree to be bound by these Conditions and Global-e’s own terms of sale, available here.
These Conditions apply exclusively to Clients who qualify as consumers under applicable legislation (Article 3 of Legislative Decree No. 206/2005 – the "Consumer Code").

2. Products and Availability
2.1 The Products offered on the Website are described and presented as accurately as possible. Giuliva Heritage reserves the right to amend or update Product information and pricing at any time without prior notice.
2.2 Product availability is not guaranteed. If an ordered item is unavailable, the Client will be informed and refunded accordingly.
3. Purchase Process and Contract Formation
3.1 To purchase a Product, the Client selects the desired item(s), adds them to the shopping cart, and completes the checkout process via the Website, where they are redirected to Global-e’s secure payment portal.
3.2 A binding sales contract is formed when the Client receives a confirmation email with the order details. This email will include a summary of the transaction, including pricing, applicable taxes and shipping costs, and a description of the purchased Product(s).
3.3 The Client confirms they are aged 18 or older and have full legal capacity to enter into a purchase agreement.
4. Prices and Payments
4.1 Product prices are displayed in local currency and include applicable VAT, import duties, and taxes unless otherwise stated. Final prices, including shipping fees, will be shown at checkout.
4.2 All payments are processed securely via Global-e, using approved methods such as credit/debit cards, PayPal, or other regionally available options.
4.3 Invoices and tax documentation will be issued by Global-e in accordance with the law and delivered electronically or within the shipment.
5. Shipping and Delivery
5.1 Shipping services are provided via Global-e and its logistics partners. Delivery times, fees, and options vary by country and are specified during checkout.
5.2 Pre-order items will be dispatched within the estimated lead time specified on the product page.
5.3 The Client is responsible for ensuring that the delivery address provided is accurate and accessible. Any changes made to the delivery address after dispatch may incur additional charges.
5.4 Upon delivery, the Client must inspect the parcel and notify customer service of any visible damage or missing items within 7 days.
6. Returns and Right of Withdrawal
6.1 The Client has the right to withdraw from the contract within 14 (fourteen) days of delivery without providing a reason.
6.2 All returns must be initiated via the Global-e returns portal, accessible here. The Client will be guided through the process and provided with a Return Merchandise Authorization (RMA) and instructions.
6.3 Return shipping fees are as follows and will be deducted from the refund amount:
• EU returns: €25 flat fee
• Non-EU returns: €35 flat fee
• Italy : Free
6.4 The Product must be returned in its original condition, unused, with all tags and packaging intact. Giuliva Heritage reserves the right to reduce the refund amount in case of diminished value caused by improper handling.
6.5 Refunds will be issued using the original payment method, unless otherwise requested and accepted, and may take up to 14 days after the returned item is received and inspected.
6.6 For any issues with high return frequency or suspected abuse of the return policy, Giuliva Heritage reserves the right to restrict access or deactivate the Client’s account at its discretion.
7. Legal Warranty and Non-Conformity
7.1 Products are covered by a legal conformity warranty valid for two (2) years from the date of delivery, in accordance with EU Directive 1999/44/EC and applicable local law.
7.2 In case of defects, the Client must notify Giuliva Heritage customer service within two (2) months of discovery, providing photos and a description of the issue. Giuliva Heritage, in coordination with Global-e, will evaluate the claim and provide instructions for return or replacement.
7.3 If the defect is confirmed, the Client may request repair, replacement, or refund, depending on availability and applicable legal rights.
8. Intellectual Property
8.1 All trademarks, logos, images, text, and other content on the Website are the exclusive property of Lady Giuliva S.r.l. and protected by intellectual property laws.
8.2 Any use, reproduction, or modification of the Website content without written consent is strictly prohibited.
9. Governing Law and Dispute Resolution
9.1 These Conditions are governed by Italian law and the Consumer Code, with particular reference to distance selling regulations (Legislative Decree No. 70/2003).
9.2 The Client has the right to submit complaints through the European Online Dispute Resolution (ODR) platform available at: http://ec.europa.eu/odr
9.3 In the absence of an amicable settlement, jurisdiction lies with the court of the Client’s place of residence or domicile, provided it is within the European Union.
